2. Applicability

These Terms apply to every consumer offer, order and Agreement made through the Website.

By placing an order, you accept these Terms.

If additional product-specific, promotional or campaign-specific conditions apply, these will be made available before purchase. If those conditions conflict with these Terms, the provision most favourable to the Consumer applies.

B2B, wholesale, retail, distributor, defence, institutional, tender, pilot and field-trial orders may be governed by separate written agreements.

3. Product information

FRONTIER¹ sells food products intended for normal dietary use.

We aim to describe all Products accurately and clearly. For food products, mandatory food information is made available before purchase where required by law. This may include:

  • product name;
  • ingredients;
  • allergens;
  • net quantity;
  • nutrition declaration;
  • storage instructions where relevant;
  • preparation or use instructions where relevant;
  • responsible food business operator.

Product images are for illustration only. Minor visual differences may occur between the Website image and the delivered Product.

FRONTIER¹ Products are food products. They are not medicinal products and are not intended to diagnose, treat, cure or prevent any disease.

You are responsible for checking the ingredients, allergens and product information before purchase and before consumption, especially if you have allergies, intolerances or specific dietary requirements.

4. Orders

An Agreement is formed when you place an order through the Website and complete the payment process.

After placing an order, you will receive an order confirmation by email. This confirms that we have received your order.

We may refuse or cancel an order on reasonable grounds, including where:

  • payment details are incorrect or incomplete;
  • the Product is unavailable;
  • there is an obvious pricing or product information error;
  • we suspect fraud, misuse or unlawful activity;
  • delivery to the stated address is not possible.

If we cancel an order after payment has been made, we will refund the amount paid without undue delay.

5. Prices and payment

All prices shown to Consumers include VAT, unless stated otherwise.

Shipping costs, taxes and any additional charges are shown before checkout is completed.

Payment is made through the payment methods offered at checkout.

We may change prices, discounts, shipping costs and shipping thresholds at any time. Changes do not affect orders already placed.

You are not entitled to a refund of a price difference if a Product is discounted after your order has been placed.

6. Delivery

Consumer delivery is currently available in the Netherlands and Belgium only.

Estimated delivery times are indicative. We make reasonable efforts to deliver within the stated timeframe, but delays may occur due to carrier issues, stock availability, force majeure or other circumstances outside our reasonable control.

The risk of loss or damage passes to you when the Product has been delivered to you or to a third party designated by you.

If a parcel is delivered to a parcel point and is not collected in time, it may be returned to us. In that case, reasonable return or reshipping costs may be charged.

B2B, retail, distributor, institutional and defence deliveries outside the Netherlands and Belgium are only available by separate written agreement.

7. Right of withdrawal

If you are a Consumer, you have the right to withdraw from the Agreement within 14 days after receiving the Product, without giving a reason.

To exercise this right, you must notify us within the withdrawal period by contacting:

info@frontierration.com

After notifying us, you must return the Product within 14 days.

The right of withdrawal does not apply to sealed food products that are not suitable for return for health protection or hygiene reasons once the seal has been broken.

For clarity:

  • unopened and sealed Products may be returned within the withdrawal period, unless another legal exclusion applies;
  • opened Products cannot be returned if they are no longer suitable for return for health protection, hygiene or food safety reasons;
  • Products that have been used, damaged or handled beyond what is necessary to establish their nature, characteristics and functioning may be refused or refunded only partially.

8. Return costs and refunds

Return shipping costs are for your account, unless the Product was delivered incorrectly, damaged or defective.

If you withdraw from the full order correctly and on time, we will refund the purchase price and the standard outbound delivery costs paid for that order. We are not required to refund additional costs for a delivery method more expensive than our standard delivery method.

If you return only part of an order, outbound delivery costs will normally not be refunded.

We may withhold the refund until we have received the returned Product or until you have provided proof of return shipment.

Refunds are made using the same payment method used for the original order, unless agreed otherwise.

9. Damaged, incorrect or defective Products

You are entitled to receive a Product that conforms to the Agreement.

If you receive a damaged, incorrect or defective Product, contact us as soon as possible at:

info@frontierration.com

Please include your order number and, where possible, photos of the Product and packaging.

If the complaint is justified, we will offer an appropriate solution, such as replacement or refund.

Your statutory rights remain unaffected.

10. Complaints

If you have a complaint about a Product, order or service, contact us at:

info@frontierration.com

We will respond as soon as possible, and in any event within 14 days after receiving the complaint. If we need more time, we will confirm when you can expect a substantive response.

A subscription renews automatically at the selected interval until cancelled.

You can cancel or modify your subscription through your account environment or by contacting us at:

info@frontierration.com

Cancellation must be completed before the next renewal date to avoid the next charge.

12. Discount codes and promotions

Discount codes are valid only under the conditions stated with the relevant promotion.

15. Liability

Nothing in these Terms limits or excludes liability where this is not permitted by law.

To the extent legally permitted, FRONTIER¹ is not liable for indirect damage, consequential damage, loss of profit, loss of business, loss of data or damage resulting from incorrect use of the Products.

Our total liability is limited to the amount paid for the relevant order, unless mandatory law provides otherwise.

16. Force majeure

We are not liable for failure or delay caused by circumstances outside our reasonable control, including carrier disruptions, supply chain issues, strikes, extreme weather, government measures, cyber incidents, power failures, production interruptions or other force majeure events.

If performance becomes permanently impossible, either party may terminate the affected part of the Agreement.

17. Changes to these Terms

We may amend these Terms from time to time.

The version available at the time of your order applies to that order.

18. Governing law and jurisdiction

These Terms and the Agreement are governed by Dutch law.

If you are a Consumer residing in another EU Member State, you retain the protection of mandatory consumer law provisions in your country of residence.

Disputes will be submitted to the competent court in the Netherlands, unless mandatory law gives you the right to bring proceedings elsewhere.
